Scope of This Agreement
“Activity” means all real-axe and Velcro-system instruction, demonstrations, practice, games, competition, handling and retrieval of equipment, movement within or near throwing lanes, spectating, and presence on the premises in connection with axe throwing. “Released Parties” means All About the Fun LLC; its members, owners, managers, employees, instructors, volunteers, contractors, affiliates, successors and assigns; the premises owner or lessor; equipment manufacturers, distributors and suppliers; and each of their insurers and representatives.
I request permission for the Participant named above to enter the Activity area and take part in the selected Activity. I understand participation is voluntary and may be refused or ended by staff at any time.
Acknowledgment and Assumption of Risk
Axe throwing involves sharp, heavy, moving objects and cannot be made completely risk-free. Velcro equipment does not have a sharpened metal edge, but Velcro play and presence near the Activity area still involve physical movement and other risks. I have had the opportunity to ask questions and understand that risks include, without limitation:
Thrown or handled equipment. Axes or Velcro implements may slip from a hand, travel outside the intended path, fail to stick, fall, rebound, ricochet or strike a person or property.
Contact hazards. Contact may occur with a blade, axe head, handle, target, barrier, fence, wall, splinter, wood or metal fragment, other participant, staff member, spectator or personal property.
Physical injuries. Possible harm includes cuts, lacerations, puncture wounds, bruises, eye or dental injuries, crushing or blunt-force injuries, strains, sprains, fractures, head or neck injuries, scarring, infection, permanent disability, paralysis and death.
Premises and movement risks. Slips, trips, falls, collisions, crowd movement, noise, lighting, uneven or wet surfaces, retrieving equipment and entering or leaving a lane may cause injury.
Human and equipment error. Risks may result from my actions, the actions of other participants or spectators, inadequate attention, failure to follow rules, equipment failure or condition, or acts or omissions of the Released Parties, including ordinary negligence, to the fullest extent permitted by law.
Health and response risks. Physical exertion may aggravate a known or unknown condition. First aid, emergency response, transportation or medical treatment may be delayed, unavailable or unsuccessful.
I knowingly and voluntarily accept and assume all inherent and other risks of the Activity, whether known or unknown, foreseeable or unforeseeable, and whether described above or not, including risks arising from the ordinary negligence of a Released Party, but excluding liability that cannot legally be waived.
Safety Covenant and Participant Responsibilities
I agree, and if signing for a minor I will instruct the minor, to:
Complete the required orientation and practice instruction; listen to and immediately follow every staff command, posted rule, lane signal and equipment restriction.
Use only equipment supplied or specifically approved by staff; never touch a blade edge; carry an axe only as instructed; and immediately report loose, damaged or unsafe equipment.
Throw only from the assigned position, toward the assigned target, and only after staff authorization. Never throw while any person is in front of the fault line or target area.
Remain behind the marked line or barrier until every implement has come to rest and staff authorizes retrieval. Walk - never run - when retrieving equipment.
Never engage in horseplay, trick shots, intentional over-rotation, throwing while facing away, catching an axe, throwing at a person or object other than the assigned target, or distracting a thrower.
Wear closed-toe, closed-heel shoes; secure loose clothing, jewelry and long hair; keep food, drinks, phones and personal items outside the active lane; and use any protective equipment required by staff.
Not participate while impaired by alcohol, cannabis, illegal drugs, medication, fatigue, illness or any condition that may reduce safe judgment, balance, strength, coordination or reaction time.
Tell staff immediately about an injury, unsafe condition, needed accommodation, or inability to understand or follow instructions; stop whenever directed; and remain in spectator-safe areas when not actively throwing.
I represent that the Participant is physically and mentally able to participate safely in the selected Activity. I understand that staff instruction, inspection and supervision reduce risk but do not eliminate it. Unsafe conduct may result in immediate removal without refund, subject to Facility policy.
Release, Waiver and Covenant Not to Sue
In exchange for permission to participate in or be present for the Activity, I, for myself and my spouse, heirs, estate, personal representatives, successors and assigns, release and forever discharge the Released Parties from every claim, demand, cause of action, damage, loss or liability arising from or related to the Activity or presence at the Facility during the one-year term of this Agreement. This includes claims for personal injury, illness, disability, death, property damage, loss of services, medical expense or other loss, whether known or unknown, and includes claims based on a Released Party’s ordinary negligence or fault as stated conspicuously above.
I covenant not to sue a Released Party on a claim released by this Agreement. If I am signing as a Parent/Guardian, this release and covenant apply fully to my own individual and derivative claims, including claims for medical expenses, loss of services or consortium. To the fullest extent Missouri law permits a parent or guardian to act for the Minor, I also give the release and covenant on the Minor’s behalf. Any portion that cannot lawfully bind the Minor shall be limited or severed without reducing the Parent/Guardian’s consent, release of the Parent/Guardian’s own claims, or the remaining terms.
Responsibility for Conduct, Property and Third-Party Claims
I am responsible for loss or damage caused by the Participant’s intentional misconduct, reckless conduct, misuse of equipment or material violation of a safety rule. To the fullest extent permitted by law, an Adult Participant will defend, indemnify and hold harmless the Released Parties from third-party claims and reasonable costs, including attorneys’ fees, to the extent caused by that Adult Participant’s negligent, reckless or intentional conduct or breach of this Agreement. A Parent/Guardian gives the same indemnity only for the Parent/Guardian’s own conduct, material misrepresentation, or breach of this Agreement. No indemnity applies to gross negligence, reckless or willful misconduct, intentional wrongdoing, or other liability that cannot legally be shifted.
Medical Authorization and Costs
If the Participant appears injured or ill, I authorize the Facility to provide or arrange reasonable first aid, call emergency services, and share information reasonably necessary for care. If I am signing for a Minor and cannot be reached, I consent to emergency evaluation, transportation and treatment that a qualified provider considers reasonably necessary. I understand the Released Parties do not promise medical personnel will be present. I accept responsibility for medical, ambulance and related costs not paid by insurance, except to the extent applicable law places those costs on another party.
Agreement Terms
Missouri law; venue. Missouri law governs this Agreement. Any court proceeding shall be filed in a court of competent jurisdiction serving Miller County, Missouri, unless applicable law requires another forum.
One-year agreement. This Agreement and any Parent/Guardian consent cover all visits, sessions, instruction, play, spectating and re-entry for one year from the Adult Participant’s signature date in Part A or the Parent/Guardian’s signature date in Part B. It expires on the first anniversary of that date; a new agreement is required before participation on or after expiration. Age and equipment restrictions and staff approval apply at every visit. A Minor who turns 18 must sign a new Adult Participant agreement before further participation.
Severability. If any provision is invalid or unenforceable, it will be narrowed or severed only to the minimum extent necessary, and the remaining provisions will continue in effect.
Entire agreement; no reliance. This document and incorporated written Facility rules are the entire agreement about the subjects addressed here. I have not relied on a promise that the Activity is risk-free or that this Agreement will not be enforced.
Electronic signatures. An electronic signature, electronic record or reliable digital acceptance may be used and will be treated as an original to the extent permitted by law.
Authority and truthful information. I certify the information supplied is accurate. A person signing as Parent/Guardian represents that they are the Minor’s parent or court-appointed legal guardian and have authority to grant participation consent.
